By accessing or using Clark AI's virtual receptionist service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Clark AI provides an AI-powered virtual receptionist service that answers phone calls on behalf of your business, collects information from callers, schedules appointments, and provides notifications. The Service is designed for business use and requires a subscription.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. Subscription and Payment

Fees

The Service requires a paid subscription. Current pricing is available on our website. Fees are billed in advance on a monthly basis and are non-refundable except as required by law.

Free Trial

We may offer a free trial period. At the end of the trial, your subscription will automatically begin unless you cancel before the trial ends.

Price Changes

We may change our fees with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new fees.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Engage in fraudulent, deceptive, or misleading practices
  • Collect information from callers for illegal purposes
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Send spam or unsolicited communications
  • Violate the rights of third parties

6. Call Handling

You understand and acknowledge that:

  • Clark AI uses artificial intelligence to handle calls, which may occasionally make errors
  • Callers will be informed they are speaking with an AI assistant
  • Call recordings and transcripts are stored according to our Privacy Policy
  • You are responsible for reviewing call information for accuracy
  • Critical or emergency calls should not rely solely on AI handling

7. Intellectual Property

The Service, including its software, design, features, and content, is owned by Clark AI and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

You retain ownership of your business information and call data. By using the Service, you grant us a license to use this data to provide and improve the Service.

8. Third-Party Services

The Service integrates with third-party services (telephony providers, calendar systems, etc.). Your use of these integrations is subject to the respective third parties' terms and policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

We do not guarantee that AI responses will be accurate in all circumstances. You should verify critical information collected through the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLARK AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Clark AI from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate your access for violation of these Terms or for any other reason with notice.

Upon termination, your access to the Service will end, but these Terms will continue to apply to your prior use.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Pennsylvania.

15. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and Clark AI regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any right does not waive that right.
  • Assignment: You may not assign these Terms without our consent.
